Trademark Infringement and Likelihood of … – Traverse Legal, PLC

As a trademark attorney, I see things every day, many of which don?t surprise me anymore.? But I have to say one thing that I really hear a lot in the area of trademark registration and trademark infringement is, ?Hey, my mark is different than the one that is being used by the trademark holder? or ?my mark isn?t exactly the same? or ?my logo is slightly different.? ?What people fail to realize is that trademarks protect around the mark.? They protect more than just the literal use of the word or the design element or the logo or the colors in the related elements of the trademark use.

So if you have trademark rights in a word, logo, symbol, design, slogan, you get to protect more than just the literal use of that trademark.? You get to have the exclusive right to use that mark in commerce as related to your goods and services or any other goods and services that might be similar to yours, and you get to preclude anyone from using something that is similar to the point that there is a likelihood of confusion from the consumer point of view.

So what in the trademark world does this concept of likelihood of confusion mean?? Well, there are any number of different factors that a court would look at in order to determine whether or not someone is infringing a trademark, whether or not there is a likelihood of confusion between the plaintiff?s trademark and the defendant?s use.? The thing that you need to understand is that if you?re in a similar market selling something that is similar, if you?re using a word or design that looks or appears to be similar, consumers might think that the defendant?s trademark or the defendant?s use is in fact sponsored or owned by or endorsed by the plaintiff trademark holder.

So the test of likelihood of confusion is a very broad one, and every case is fact specific.? If you receive a trademark infringement threat letter, someone is alleging that you are infringing their mark in commerce.? Do not rely on the slight differences between what you?re doing and what the complaining party is doing with their mark.? That?s not going to get you anywhere.? You have to put yourself in a consumer?s point of view and say, ?If I saw the two marks side by side and I saw what each company was doing, would I potentially be confused about who was who? Would I be confused about the source and origin of the goods and services that I was buying??? Not only do we protect the Nike Swoosh, in the area of sporting goods and apparel and shoes, but we protect against any use that is similar to the Nike Swoosh, because we don?t want consumers to be confused about who they?re dealing with.

A good trademark infringement attorney is going to tell you, if you receive a cease and desist threat letter for trademark infringement, that you?ve got a big problem if your use is similar.? Here is the problem from the defendant?s point of view.? You might get shut down.?? You?ve got an investment in the use of a domain name perhaps.? Perhaps your using the trademark in your marketing materials.? If you?ve received a trademark infringement threat letter claiming substantial similarity, are you going to continue to invest your time and money in that use, knowing that at some point down the line you could be shut down, and even more so you could be liable in a trademark infringement lawsuit for up to $150,000 and statutory damages plus attorney fees? ?How much time and effort are you going to want to continue to put into that mark?

One thing that trademark lawyers at trademark law firms will do for clients who are in the defensive position who have been accused of trademark infringement is try and negotiate an exit strategy for the defendant when there is a problem.? So if you think that you may be in a difficult situation, either because you can?t afford to fight the fight, or because you now realize that just because your trademark is slightly different that it?s not going to potentially help you in a court of law, or if you didn?t realize that trademark law protects around the trademarks broader than the literal use of the mark but now you do, you need to negotiate an exit.? You might get a joint use agreement with the plaintiff.? You might be able to buy yourself some time to transition out of your current inventory and transition into a new mark.

Here are the lessons for today from this trademark attorney.? Make sure before you brand your goods, your services, your company, you have a competent trademark law firm do a trademark availability search.? You do not want to invest in a brand that you later have to change.? It could put you out of business.? If you?ve already chosen a brand and you receive a trademark infringement threat letter, then you need to get a good trademark law firm involved in order to be able to understand what your risk is, what your rights are, what options you have, and what the recommendation of the attorneys are in terms of moving forward.

When there becomes too much else to do, the entrepreneur finally decides to stop doing the books and hires a bookkeeper.

As demand increases and more sales opportunities arise, a salesperson is hired to help. When more and more workers get hired, a supervisor is named to manage day-to-day operations. And when a new location is opened, a manager is brought in to help run it.

With each of these decisions the entrepreneur starts to create an organizational structure.

As the business grows, employees are organized into specific functions such as bookkeeping, sales and operations, and eventually someone is put in charge of each of these departments.

While the decisions an entrepreneur makes to handle each specific challenge may make good sense individually, sometimes it doesn?t add up to a complete whole after the structure has been pieced together.

To be effective, the organization?s structure needs to align with the overall market strategy that the business is pursuing.

In their classic book, The Discipline of Market Leaders, Michael Treacy and Fred Wiersema identify the three common competitive strategies of successful businesses. They conclude that there is a specific alignment of structure, culture and systems necessary to support the chosen strategy.

The first competitive strategy is operational excellence. This is what a business needs to be efficient, consistent and low-cost.?? Burger chain McDonald?s is a good example of this strategy, as its customers want the same food served quickly and inexpensively in every McDonald?s they visit. This strategy works best with what might be called a bureaucratic structure, where decision-making is completely centralized at the top levels of the business with tight controls to ensure consistent performance.

The second strategy is product leadership, in which the business seeks to be the leading innovator in its market. This is a common strategy of many technology businesses. The structure that works best with this strategy is one that is flexible and can quickly adapt to each new product offering.? People are reassigned and reorganized to meet the unique needs of each new product.

The third strategy is customer intimacy. This strategy ? as it evolves ? must allow any employee to do what needs to be done to meet the needs of the customer.?? A common mistake of small businesses is that, as they grow, they try to pursue all of these strategies at once. This is never sustainable over the long run.

Each strategy demands a specific approach to organizing how work gets done.

A key to being a successful venture and managing growth is finding the competitive strategy that works best for the market, and then working to build a structure over time that supports that strategy.

There is no one best structure for all businesses. But there is a best structure for the type of market strategy that a business chooses to pursue. Find it.

Young adults with autism lag in school, work

NEW YORK (Reuters Health) – Young adults with autism are less likely to go to college or hold down a job than their peers with other types of disabilities, a new U.S. study finds.

Researchers found that more than one-third of young adults with an autism spectrum disorder had not gotten a job or gone into higher education since high school. And that number was much higher compared with young adults with learning disabilities or other impairments.

It’s estimated that about one in 88 U.S. children has an autism spectrum disorder, or ASD.

That’s up 78 percent from a decade ago — which health officials attribute to better diagnosis, as well as broader definitions of what constitutes an ASD.

ASDs are a group of developmental brain disorders that hinder a person’s ability to communicate and interact socially — ranging from the severe cases of “classic” autism to the relatively mild form called Asperger’s syndrome.

But while rates of ASD diagnoses are shooting up, researchers have not known all that much about how kids with the disorders fare after high school.

So for the new study, researchers collected data on 680 young U.S. adults with an ASD, along with nearly 1,400 young people with learning disabilities, speech or language impairments or intellectual impairment.

All were between the ages of 19 and 23, and had been in special education programs when they were in school.

Overall, the study found, 35 percent of young adults with ASDs had not gone to school or held a job since high school.

That compared with only 7 percent of young adults with speech or language impairments, and 3 percent of those with learning disabilities. Even young people with intellectual impairments were faring better than the ASD group: one-quarter had not gone on to higher education or the workplace after high school.

The findings appear in the journal Pediatrics.

GAP ?STRIKING’

It’s not surprising that many young adults with ASDs would struggle, according to Paul T. Shattuck, the lead researcher on the study.

“But I wasn’t prepared for the magnitude of the effect,” said Shattuck, an assistant professor at Washington University in St. Louis. “The gap between them and young people with other disabilities was striking.”

Another important finding, Shattuck said, was that low-income adults with ASDs were at substantial risk.

Among young adults from families making under $25,000 a year, 55 percent had not worked or started higher education since high school.

That compared with 18 percent of those from families who made more than $75,000 a year.

“That’s a huge difference,” Shattuck said. The reasons for the gap are not clear from the study, he noted — but it likely has something to do with access to services for people with ASDs.

Another reason, according to Shattuck, may be that higher-income families have more social connections, including people who could help their child find work or get into school.

The researchers estimate that in 2009, about 163,000 U.S. children with an ASD were living below the poverty line.

?DOESN’T MAGICALLY DISAPPEAR’

There are some services available to help families and kids with ASDs prepare for life as an adult. Shattuck said that special ed programs should include, “as part of the package,” some type of transitioning plan for the post-high school years.

“That’s the goal anyway,” he said. “The reality is, not every kids gets that, and the quality of (the service) will vary from place to place.”

There is definitely a need for more research into services for young adults with ASDs, according to Shattuck’s team — particularly programs to help kids from low-income families.

The “popular image” associated with autism is the affected child, Shattuck noted.

“But autism doesn’t magically disappear in adolescence,” he said. “These kids grow up, and that’s the age group we know the least about.”

Light from alien ‘super-earth’ seen for first time

NASA’s Spitzer space telescope has detected a light source coming from a large earth-like planet.

Light from an alien “super-Earth” twice the size of our own Earth has been detected by a NASA space telescope for the first time in what astronomers are calling a historic achievement.

NASA’s infrared Spitzer Space Telescope spotted light from the alien planet 55 Cancri e, which orbits a star 41 light-years from Earth. A year on the extrasolar planet lasts just 18 hours.

The planet 55 Cancri e was first discovered in 2004 and is not a habitable world. Instead, it is known as a super-Earth because of its size: The world is about twice the width of Earth and is super-dense, with about eight times the mass of Earth.

But until now, scientists have never managed to detect the infrared light from the super-Earth world.

“Spitzer has amazed us yet again,” said Spitzer program scientist Bill Danch of NASA headquarters in Washington in a statement today (May 8). “The spacecraft is pioneering the study of atmospheres of distant planets and paving the way for NASA’s upcoming James Webb Space Telescope to apply a similar technique on potentially habitable planets.”

Spitzer first detected infrared light from an alien planet in 2005. But that world was “hot Jupiter,” a gas giant planet much larger than 55 Cancri e that orbited extremely close to its parent star. While other telescopes have performed similar feats since then, Spitzer’s view of the 55 Cancri e is the first time the light from a rocky super-Earth type planet has been seen, researchers said.

Since the discovery of 55 Cancri e, astronomers have pinned down increasingly strange features about the planet. The researchers already knew it was part of an alien solar system containing five exoplanets centered on the star 55 Cancri in the constellation Cancer (The Crab). But 55 Cancri e stood out because it is ultra-dense and orbits extremely close to its parent star; about 26 times closer than the distance between Mercury and our own sun.

The new Spitzer observations revealed that the star-facing side of 55 Cancri e is extremely hot, with temperatures reaching up to 3,140 degrees Fahrenheit (1,726 degrees Celsius). The planet is likely a dark world that lacks the substantial atmosphere needed to warm its nighttime side, researchers said.

And to top it all off, the planet is oozing.

Past observations of the planet by the Spitzer Space Telescope have suggested that one-fifth of 55 Cancri e is made up of lighter elements, including water. But the extreme temperatures and pressures on 55 Cancri e would create what scientists call a “supercritical fluid” state.

Supercritical fluids can be imagined as a gas in a liquid state, which can occur under extreme pressures and temperatures. On Earth, water can become a supercritical fluid inside some steam engines.

Miracle Hands: Alumni Theresa Martin Provides Healing Massage to …

Fall Quarter 2011 Massage Therapy graduate, Theresa Martin jumped at the chance to voluntary provide massage during the ?Reborn Through Fire? fitness event at Verona Middle School. What she didn?t imagine would happen next made her day.

Celebrity fitness guru Billy Blanks, creator of the Tae Bo? Fitness headlined the event by leading two fitness classes. Theresa helped out by providing complimentary sports massages to participants after their workout.

As the day came to a close, Theresa made a move and inquired with a Billy Blank?s staff person asking if Mr. Blanks would like a massage. The staff person came back to say he would come out for a brief massage and photo.

When Mr. Blanks met with Theresa, he noted that he had limited neck mobility. Theresa worked on Mr. Blanks and the 5 minute massage turned into 25 minutes sports massage.

Theresa beamed as she shared what Mr. Blanks said to her after. ?He said to me ?Do you know you have miracle hands, your hands really can heal.? He said that the massage helped with his neck, allowing him a broader range of motion.?

Reflecting on working on Mr. Blanks, Theresa said ?I didn?t really have to figure out where the different muscles were because they were really defined. Billy Blanks is a great motivational speaker and a super down to earth, caring person. He took time to take photos and sign autographs with everyone. That says a lot about a person.?

?Reborn Through Fire,? served as a local fundraiser event which benefited the UW Health Burn Center.
